the binary doesn't need to be built for 2.6 in order to be able to
function on a 2.6 kernel.

In fact, here's an arm machine with a 2.6 kernel using a binary built
for 2.4:

0 igor:~# uname -a
Linux igor 2.6.18-4-ixp4xx #1 Sun Apr 22 08:34:11 UTC 2007 armv5tel GNU/Linux
0 igor:~# file /bin/ls
/bin/ls: ELF 32-bit LSB executable, ARM, version 1 (ARM), for GNU/Linux 2.4.1,
dynamically linked (uses shared libs), for GNU/Linux 2.4.1, stripped
0 igor:~# /bin/ls /
bin dev home lib media opt root srv target usr
boot etc initrd lost+found mnt proc sbin sys tmp var
0 igor:~#
