Just a note, this reminds me of a discussion on #dbmail about 2 years back over exactly this issue - there was an ISP who prevented a user from downloading their mail while still accepting smtp; during that time a nice job offer was sent to her which she didn't get (or know to be expecting), and the employer gave up on her and gave the job to someone else; she sued the ISP and won.
