Hi Rick,

have a look at <http://developer.apple.com/mac/library/samplecode/LoginItemsAE/index.html > and the Readme file that comes with it.
In part, it says:

"Due to a bug <rdar://problem/4052117> in Mac OS X 10.4 and later (up to including 10.4.2, which is the latest release at the time this was written), LoginItemsAE can't handle hidden login items properly. That is, the value of kLIAEHidden is always false and you can't add a hidden login item. This bug does not affect earlier systems."
Are you using Apple Events to create your login item?  If so, this bug  
could be causing your problem.  I haven't yet examined the sample code  
(just looked at it quickly today), but I think you can get the hidden  
part to work using one of the other methods of creating a login item.
