Maybe its due to the AppArmor policy then, see https://help.ubuntu.com/community/AppArmor. Try putting apparmor in complain mode for freshclam, and then see if it works and if it logs any errors. If it works then you can create a custom AppArmor policy, or just keep it turned off for freshclam.
