Have discovered the answer.  And feel a little sheepish.  It turns out that
even though apparmor did not show up in a ps command, apparently clamav can
still make calls to its config file?  In any case I got the following
information for the creators of the piece of software that uses clamav.
The said  since I had Ubuntu try the following commands.

sudo /etc/init.d/apparmor stop
sudo udpate-rc.d -f apparmor remove
sudo /etc/init.d/clamav-daemon restart

And now clamdscan works like a charm and I am up and running.  Thanks
