My apoligies if that is the case.  However, I do know that Trend
detected this before the new definitions were released as well.
However, they were unable to effectively stop it since this is a new
variant.
 
This is a medium alert for many vendors (see
http://secunia.com/virus_information/14877/bagle.bj/) so my guess is
that some are caught and some are not.  There are a few variants out
there.
