It's available in MacPorts[1]. I don't know if that's legal or not, but they could probably get around it since the Unix core in Mac OS X is open source. It's the graphical shell on top of that that is proprietary. I would say that it's roughly similar to running a proprietary X server on a commercial Linux distribution, which I assume you can still run OpenMotif on. But that's just speculation.
