Thanks, Doug. I don't know if he _is_ that poorly thought of in general, but he _definitely_ is by me. Stuart Taylor had some good articles on the topic in The National Journal, which I think were reprinted on-line in The Atlantic and you might find there. I should also say that my opinions about Rehnquist's judicial philosophy are probably colored by the fact that I think there's pretty good evidence that he wrote a brief in favor of segregation when he was a clerk on the court during Brown v. Board, along with some other unsavory racial stuff in his past (buying a house with a restricted covenant, for example). Not saying that any of those things make him a racist...but they are unsavory and impose a positive obligation on the Chief Justice of the United States to make some steps to demonstrate otherwise (like hiring black clerks, for example). And he hasn't exactly done that either. That aside, I have a _very_ poor opinion of his judicial philosophy. I'll try and look up some more articles on the topic when I get a chance. But conservative judicial usurpation is no better - and sometimes worse - than its liberal counterpart, and I _must_ to oppose the one if I oppose the other. ===== Gautam Mukunda [EMAIL PROTECTED] "Freedom is not free" http://www.mukunda.blogspot.com __________________________________ Do you Yahoo!?
