Divisions are indeed formed as they are raised. Of all the US divisions, the first 25 are, by law, peacetime Federal complement of the army. Division numbers 26-75 all belong to the National Guard. 76+ are special emergency wartime complement. By special act, however, the 82nd and 101st remained active after WWII and were transferred to peactime federal command.
