Once you're in a shooting war, any death caused by said war is not 
assassination, but casualty of war.  Technically, anyway.  If someone 
actually pulls a trigger on him, if said trigger-puller knows just who the 
heck he's shooting, then in *spirit* it might be assassination.

(Also, if there are orders to capture him alive if at all possible, then 
if the trigger-puller knows who he's shooting, he'd better have a darn 
good explanation as to why he killed, rather than captured.)
