This leaves a spot for a guess they should do what? To upgrade, or to use
a proper previous succesfull backup as a reference?

I also used to think they would upgrade to full, but recently I noticed
(first time a job failed, due to cancellation after tape got full) a
differential job used old full backup -at first I thought this was logical,
but then it looked to me that it had been using some very old (it looked for
me older than the file retention period?) job as a reference. I was busy
enough for other reasons, so I manually ran a full one and forgot that
matter.

So, I wouldn't find it completely impossible that there could be a problem
with upgrades after fail. Unfortunately, I had no resources to investigate
the matter at that time. I was (and still am) running 1.38.3.
