I don't know if this has been filed as a formal bug. The gist of it is that the "data" table is protected by Facebook restricted access, and photos are stored in the "data" table. So the restriction is applied to them as well. There should be an exception made for photos, at least when they are accessed using the "/photo" URI. Unfortunately this still has not been fixed.
