I think the more interesting question is whether it enacted a regulation (which has a lower standard): the rule vs. regulation ambiguity might potentially have been resolved via the imprecision of the specification. That said, there's also ambiguity around who the Promulgator would be, which might tip the balance there into "the proposal is trying to enact a rule". -- ais523
