While I'm not in favor of this scam, I won't support a judgment of AFFIRM for two reasons: 1. I disagree with Murphy's arguments. 2. I'm still of the belief that AFFIRM (and even more so OVERRULE) should be used sparingly in the first appeal of any case. I (if possible) pre-emptively support any judgment of REMAND or REASSIGN.
