That doesn't matter, to find inequity you need some party (to call the 
case) and a judge to agree that there exists "a state of affairs whereby 
events have not proceeded as envisioned by the contract (such as, 
but not limited to, a party acting in contravention of eir contractual

obligations)."

An example settlement would be a settlement that bans the AFO from
harvesting those particular numbers, thereby "devolving" the responsibility
in that it punishes the AFO collectively for not adequately regulating 
its members' individual actions with respect to upholding the spirit of 
the contract it has entered.

(Not particularly arguing for it one way or another in this case, just an 
example of how it *could* work).
