Yes. If one believes that an action is not possible, then it is dishonest to claim to perform it, such as by attempting to do so without any indication of one's belief. Only the most boring scams would rely on this kind of dishonesty. Actions that are of uncertain legality can always be preceded by "If it is possible,". -zefram
