Hmm. Here is the rule at the time of CFJ 1314
Any communication which has been sent via a Public Forum shall
be considered to have been made publicly.
Same wording. The only difference is that while in that case the list
moderator got it, here nobody got it. Why should I be penalized for
the server's failure (or, perhaps, lack thereof) to log rejected
messages?
CFJ 1314's implicit precedent may be overturned, not because the
wording of the rule has significantly changed, but because this
aspect was not considered at the time. Personally, I would
interpret "sent via the PF" as "sent to the PF's subscribers",
hence notifying the moderator doesn't count until/unless e
approves the message.
