This would just be useless text if the final judicial outcome is in
favor of Partnerships anyway.  Couldn't we at least wait to see how
the appeal turns out?

Hardly useless, as it explicitly closes the potential gap in
interpretation that's recently been under discussion.  In
general, just because the courts have decided something
doesn't mean that we shouldn't explicitly legislate that thing.
