We are also seeing something similar to this. We are trying to add a label that does not exist (either with ACTIVE or REMOVED status via the API or when viewing the AdWords UI) and get LabelError.DUPLICATE_NAME via the API. The UI also returns "You're already using this label name" when trying to add it there.
We are unable to add the label, and our application relies on the existence of the label.
