What "manual" says that the "Exchange Tracking Log is vital for Exchange Server recovery"? That isn't true. You do not need the tracking logs to recover an Exchange Server.
You may still want to back those files up... Since these files could be changing, you could change the to copy serialization to dynamic or shared dynamic. Or... use the new 5.2 feature to back up open/locked files.
